This website and the Group HIIT iOS app are operated by Group HIIT, LLC ("Group HIIT"). Throughout the site and app, the terms “we”, “us” and “our” refer to Group HIIT. Group HIIT offers this website and app to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here. By visiting our site, using our app, and/or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”). Parts of our service utilize third-party platforms to provide you with a seamless experience, including Shopify Inc., Clerk for secure account authentication, and RevenueCat for subscription management.

SECTION 1 - ONLINE STORE & APP TERMS

By agreeing to these Terms of Service, you represent that you are at least 13 years of age (or 16 years of age if located in certain European jurisdictions), and that you are at least the age of majority in your state or province of residence. You may not use our products or services for any illegal or unauthorized purpose nor may you violate any laws in your jurisdiction. A breach or violation of any of the Terms will result in an immediate termination of your Services.

SECTION 2 - GENERAL CONDITIONS

We reserve the right to refuse service to anyone for any reason at any time. You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service without express written permission by us.

SECTION 3 - DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY

We do not guarantee, represent or warrant that your use of our service will be uninterrupted, timely, secure or error-free. You expressly agree that your use of, or inability to use, the service is at your sole risk. In no case shall Group HIIT, our directors, officers, or affiliates be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind.

YOU SHOULD CONSULT WITH YOUR PHYSICIAN BEFORE BEGINNING THIS OR ANY EXERCISE PROGRAM. YOU SHOULD BE IN GOOD PHYSICAL CONDITION AND BE ABLE TO PARTICIPATE IN THE EXERCISE PRIOR TO UTILIZING ANY GROUP HIIT VIDEO OR OTHER INFORMATION OR MATERIAL.

Any exercise program may result in injury. To reduce the risk of injury, before beginning this or any exercise program, please consult a healthcare provider. The exercise instruction and advice presented are in no way intended as a substitute for medical consultation. We disclaim any liability from and in connection with this program.

BY VOLUNTARILY UNDERTAKING ANY EXERCISE DISPLAYED ON THIS WEB SITE OR APP, YOU ASSUME THE RISK OF ANY RESULTING INJURY. IF AT ANY TIME YOU EXPERIENCE DIZZINESS, FAINTNESS, SHORTNESS OF BREATH OR PAIN OR DISCOMFORT STOP EXERCISING IMMEDIATELY AND CONSULT YOUR PHYSICIAN.

Risk of Injury, Exclusion of Warranties and Liability

By viewing Group HIIT videos or engaging in any activity described therein you agree that you do so at your own risk, assume all risk of injury to yourself, and agree to release and discharge Group HIIT from any and all claims or causes of action, arising out of Group HIIT’S alleged or actual negligence. Group HIIT specifically DISCLAIMS LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES. Group HIIT does not represent or warrant that this website, any links contained therein or its server are free of viruses or other harmful components.

SECTION 4 - MODIFICATIONS TO THE SERVICE AND PRICES

Prices for our products and subscriptions are subject to change without notice. We reserve the right at any time to modify or discontinue the Service without notice.

SECTION 5 - PRODUCTS OR SERVICES

Certain products or services may be available exclusively online through the website or app. We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction.

SECTION 6 - ACCURACY OF BILLING, ACCOUNT INFORMATION, AND REFUNDS

You agree to provide current, complete and accurate purchase and account information.

  • Refunds for Direct Website Purchases: Customers who purchase directly through the Group HIIT website may request refunds by sending an email to contact@grouphiit.com. Refunds are reduced by the amount of transaction fees incurred by Group HIIT.
  • Refunds for App Store and Roku Purchases: If you purchase a subscription through a third-party platform such as the Apple App Store (iOS) or Roku, your billing relationship is directly with that platform. We cannot process cancellations or issue refunds for purchases made through the Apple App Store or Roku. All requests for refunds must be directed to Apple or Roku Customer Support and are subject to their policies.
  • Refunds and Returns for Physical Merchandise: Our physical merchandise is custom-created to order using third-party print-on-demand and dropshipping partners. Because these items are manufactured specifically for you, we cannot offer returns, exchanges, or refunds for buyer's remorse or sizing issues. We only offer refunds or replacements if the item arrives materially damaged, defective, or misprinted. Please contact us within 30 days with photos.

SECTION 7 - OPTIONAL TOOLS

We may provide you with access to third-party tools over which we neither monitor nor have any control nor input. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools.

SECTION 8 - THIRD-PARTY LINKS

Third-party links on this site may direct you to third-party websites that are not affiliated with us. We are not responsible for examining or evaluating the content or accuracy and we do not warrant and will not have any liability or responsibility for any third-party materials.

SECTION 8.1 - THIRD-PARTY AUDIO AND EXPLICIT CONTENT

To enhance your workout experience, we may embed or link to third-party audio players, such as Spotify playlists. Please be aware that these playlists are hosted and controlled by third parties, and the songs included may contain explicit language, profanity, or mature themes. Group HIIT does not censor or control this third-party audio content. We assume no responsibility or liability for any lyrics or audio content that you or others may find offensive, explicit, or inappropriate. You choose to interact with and listen to these third-party playlists entirely at your own risk.

SECTION 8.2 - THIRD-PARTY ADVERTISEMENTS

Our Service, including our video content, may display advertisements served by third-party providers such as Google Ad Manager and JW Player. Group HIIT does not explicitly endorse the products or services featured in these third-party advertisements. Your interactions, correspondence, or business dealings with any advertisers found on or through our Service are solely between you and the advertiser. Group HIIT is not responsible or liable for any loss or damage of any sort incurred as the result of any such dealings or as the result of the presence of such advertisers on the Service.

SECTION 9 - USER COMMENTS, FEEDBACK AND OTHER SUBMISSIONS

If you send creative ideas, suggestions, or other materials, you agree that we may, at any time, without restriction, edit, copy, publish, distribute, translate and otherwise use in any medium any comments that you forward to us.

SECTION 10 - USER PROFILES, PHOTOS, AND ACCEPTABLE USE

You may have the option to create a user profile and upload a profile photo via our authentication provider, Clerk. We maintain a very conservative, family-friendly environment. You are strictly prohibited from uploading any content or imagery that contains nudity, sexually explicit material, violence, hate speech, profanity, offensive gestures, illegal acts, or that infringes on the intellectual property rights of any third party.

Right to Moderate and Terminate: Group HIIT strictly reserves the right, at our sole and absolute discretion and without prior notice or liability, to review, reject, or permanently delete any profile photos or user-generated content for any reason. Furthermore, Group HIIT reserves the right to suspend, ban, or permanently terminate any user account for misconduct, abuse, or violation of these rules. Group HIIT bears no liability to you or any third party for the removal of your content or the termination of your access.

SECTION 11 - PERSONAL INFORMATION

SECTION 12 - ERRORS, INACCURACIES AND OMISSIONS

Occasionally there may be information on our site or in the Service that contains typographical errors, inaccuracies or omissions. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders at any time without prior notice.

We reserve the right to terminate your use of the Service for violating any of the prohibited uses.

We are not responsible if information made available on this site is not accurate, complete or current. The material on this site is provided for general information only.

SECTION 15 - INDEMNIFICATION

You agree to indemnify, defend and hold harmless Group HIIT and our affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service.

SECTION 16 - SEVERABILITY

In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service.

SECTION 17 - TERMINATION

These Terms of Service are effective unless and until terminated by either you or us. If in our sole judgment you fail to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice.

SECTION 18 - ENTIRE AGREEMENT

These Terms of Service and any policies or operating rules posted by us on this site or in respect to The Service constitutes the entire agreement and understanding between you and us and govern your use of the Service.

SECTION 19 - GOVERNING LAW

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of New Mexico.

SECTION 21 - SUPPLEMENTAL TERMS FOR APPLE iOS USERS

If you are accessing our app via the Apple App Store, the following additional terms apply:

  1. Acknowledgment: You and Group HIIT acknowledge that these Terms are concluded between you and Group HIIT only, and not with Apple. Group HIIT, not Apple, is solely responsible for the App and its content.
  2. Maintenance and Support: Group HIIT is solely responsible for providing any maintenance and support services for the App. You acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services.
  3. Warranty: Group HIIT is solely responsible for any product warranties. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App to you; and to the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App.
  4. Product Claims: You and Group HIIT acknowledge that Group HIIT, not Apple, is responsible for addressing any claims relating to the App, including product liability claims, failure to conform to legal requirements, and consumer protection claims.
  5. Third-Party Beneficiary: You and Group HIIT acknowledge and agree that Apple, and Apple’s subsidiaries, are third-party beneficiaries of these Terms of Service, and that upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
